By accepting an invoice, authorizing work, or permitting services to be performed, the Customer agrees to the following Terms and Conditions:
1. Scope of Services
Redline Fire and Safety (“Redline”) provides inspection, testing, maintenance, repair, installation, training, and related life-safety services in accordance with applicable NFPA, AHA, ARC, manufacturer, and industry standards as of the date of service. Redline does not guarantee future compliance, prevent all hazards, or ensure the absence of fire, injury, illness, death, or property damage.
2. No Guarantee or Warranty
Redline makes no express or implied warranties, including but not limited to any warranty of merchantability or fitness for a particular purpose. Fire protection equipment, AEDs, and training programs reduce risk but do not eliminate it.
3. Customer Responsibilities
Customer is responsible for:
Maintaining clear access to all equipment
Ensuring equipment is not tampered with after service
Performing routine checks and maintenance between service visits
Ensuring trained personnel remain current and competent
Notifying Redline of changes in occupancy, use, or hazards
Complying with all local, state, and federal codes and regulations
Redline is not responsible for deficiencies caused by building conditions, misuse, lack of maintenance, expired certifications, environmental conditions, vandalism, theft, or unauthorized modifications.
4. Training Services Disclaimer
Training provided by Redline is educational in nature only and does not constitute medical, legal, or professional advice. Redline does not guarantee participant performance, competency, or outcomes during real-world emergencies. Customer assumes all risks associated with the use or misuse of skills taught during training.
5. AED Sales, Service & Use Disclaimer
Redline is not the manufacturer of AEDs and makes no representations beyond those provided by the manufacturer. Redline is not responsible for:
AED failure due to battery depletion, pad expiration, environmental conditions, misuse, or lack of routine checks
Delayed or improper use of an AED
Medical outcomes related to AED deployment or non-deployment
Customer is solely responsible for ensuring AED readiness, accessibility, registration (where required), medical oversight, and compliance with Good Samaritan and other applicable laws.
6. Limitation of Liability
To the fullest extent permitted by law, Redline’s total liability for any claim arising out of or related to services, training, or equipment provided shall not exceed the amount paid for the specific service or product giving rise to the claim. In no event shall Redline be liable for indirect, incidental, special, consequential, or punitive damages.
7. Indemnification / Hold Harmless
Customer agrees to defend, indemnify, and hold harmless Redline Fire and Safety, its owners, officers, employees, instructors, and agents from any and all claims, damages, losses, liabilities, costs, or expenses (including attorney’s fees) arising out of or related to:
Fire, injury, illness, death, or property damage
Training participation or application of training
AED ownership, placement, maintenance, or use
Failure of equipment to operate as intended
Alleged code or regulatory violations
Customer’s failure to maintain equipment or certifications
Third-party claims related to services or products provided
8. Authority to Perform Work
Customer represents that they have the authority to authorize services, training, and equipment purchases at the listed property and agree to these Terms & Conditions on behalf of the property owner or organization if applicable.
9. Payment Terms
Payment is due per invoice terms. Past-due balances may be subject to service suspension, collection costs, interest where permitted by law, and reasonable attorney’s fees. Customer agrees to pay all costs incurred in collection.
10. Governing Law & Venue
This agreement shall be governed by the laws of the State of Ohio. Venue for any dispute shall lie in the county where Redline Fire and Safety is located.
12. GDPR & Communications Notice
Redline Fire & Safety may use contact information provided on this invoice to communicate service updates, safety information, and relevant marketing communications. Personal data is processed lawfully and in accordance with the General Data Protection Regulation (GDPR). Contact information is never sold or shared for marketing purposes. You may opt out of non-essential communications or request access, correction, or deletion of your personal data at any time by contacting us.
13. Entire Agreement
These Terms & Conditions constitute the entire agreement regarding services, training, and products provided and supersede any prior agreements, written or oral. Any modifications must be in writing and signed by Redline.
